What happened
In June 2018 the Justice Department declined to defend the ACA's pre-existing condition protections in Texas v. United States, and in a brief filed June 25, 2020 the administration asked the Supreme Court to strike down the entire law, including those protections. The Supreme Court rejected the challenge in California v. Texas in June 2021. No replacement protection was ever enacted.
