On February 20, 2026 the Supreme Court ruled against the tariffs in Learning Resources, Inc. v. Trump; he called the ruling "deeply disappointing," said he was "ashamed of certain Members of the Court," and thanked Justices Thomas, Alito and Kavanaugh for their dissents.
